jansing. we have a taste of what's to come from president obama the other day. now mitt romney is getting his turn. both speaking to the american society of news editors, president obama tuesday, mitt romney yesterday, and the gloves are off. >> the president came here yesterday and railed against policies no one is making and criticizing policies no one is making. it is one of his strategies to distract us from his record. while i understand the president doesn't want to run on his record, he can't run from his record either. >> fighting words indeed. joining me now, "the new york times" columnist, charles glow and cheryl from new york. thanks for coming. we talked about romney's ability to connect with voters. "the washington post" showed favor ability 20 points lower than president obama, and romney ended with this comment

yesterday, essentially saying you have to -- don't just like me, believe in me. i want to play this to you. >> this november we'll face a defining position. our choice will not be one of party or personality. this election will be about principle. >> to me, a very sober mitt romney. we heard all along from mitt romney, believe in america, believe in this optimistic that we're in the dark ages under president obama. he seems to be shifting to this sob sober, i know what i'm doing, let me get my hands on washington. does that message resonate with mitt romney? can he be the sober candidate? >> mitt talks about you can't run from his record, that's his problem actually. he can't run from the positions he has held. that's going to be the biggest thing around mitt romney's neck. number two, you don't have to win the base on either side in

this cl this, democrats are voting democratic, republicans are voting republican. you're fighting over a thin slice in the middle, and the middle has two segments. truly engaged but not really attached to either one, but then the bigger part of the middle, a big tumbleweed. they have to be won, they're attracted to someone with vision, who they actually believe in. they're not deep into policy. they're not going to be -- they're not going to vote on who's doing what to medicare. they really have to attach themselves to the person, and mitt has a big problem according to the polls in that he is not selling himself as a likeable, believable human being. >> and on that point, you watched the final four the other night, barack obama at half time, long interview, michelle

obama on the biggest loser, there's a culture of personality that mitt romney can't compete with. >> and i think the more mitt romney tries to be likeable, worse off he is. what's interesting, the obama white house has done a fairly good job making the president likeab likeable, no matter what the economy shows, no matter the dow-jones average. what they've done, they've done media opportunities on "the biggest loser" with michelle obama, kept his like ability rating up there which will be interesting. national elections come down to the people in the middle. a lot of times voters think with their hearts and not their heads. if they find obama more likeable and optimistic end of the day, he'll probably win their vote. it is interesting that romney came out with a pessimistic strategy. he wants to remind voters, the economy isn't that good yet, don't believe it yet.

>> sober mitt. >> it is gloom and doom. >> me against the world mentality, which is that i'm the only person in this race that has a serious understanding of how bad the situation is. i might not be the fancy guy, i might not be the guy with the -- he has a beautiful family, beautiful family, young kids, but believe in me. seems that mind set he is perpetuating, is it going to appeal to swing voters? >> it is a losing argument in a presidential election. you can't go to voters say vote pessimism, not optimism. optimism wins in presidential elections, it just does. what you have to do is to have a vision for america that moves the country forward, that galvanizes people in the middle, that says i want to do things you would like to see done. if you don't have that vision

and that message as a candidate, that optimistic vision as a candidate, you can't do that. you're talking 5, 8, 10 percentage points. you're not going to have a 70/30, that's not going to happen. >> the few, the proud, the meaningful. another person joining me, congressman from pennsylvania. thanks for being on the program. how are you doing? >> doing great, good morning, opening of baseball season. >> phillies fan there. >> let's talk about your state of pennsylvania. rick santorum says he still has a shot to win his home state. he said this yesterday. >> well, he's out of touch. >> we plan on winning here. as i said last night, people in pennsylvania know me, all of the negative attacks are i think going to fall on a lot of deaf ears.

>> you know pennsylvania politics. can rick santorum pull this out against mitt romney? >> no. he would lose his home state. i think the reason he is taking five days off is so that he can contemplate how he might exit this race. i think the primary race for the republicans has been entertaining, but i think its come to -- it's run its course. >> i want to talk about the general election in pennsylvania. it is one of the swing states, president obama in the latest gallup poll performed better than he had in fall. james cargill said it is philadelphia and pittsburgh with alabama in between. those alabama voters aren't big fans of president obama. do you see from this point now enough turnout from philly and pittsburgh for president obama to win in november, or can mitt romney play well in main line areas with suburban swing voters. >> we'll go through normal motions. pennsylvania will be in play

until the last 30 days of the race, then the democrat, in this case barack obama, as was the case for john kerry, gore, clinton vote times will move out front and you'll see less emphasis in pennsylvania because in truth, it will come back home. republicans tried to think about changing way electoral votes were gathered in pennsylvania, but decided to go with voter suppression approach. but at the end of the day, still we'll be able to carry the state, it will be competitive for awhile. i think romney will be -- there will be a lot of opportunity for us to explore his points of views on a lot of the issues because he has changed it so many times. but particularly in terms of the manufacturing and industrial base of the country, his notion of walking away from the auto industry, his notion of let, you

know, i don't think this will bode well in pennsylvania. >> i want to go back to the panel. in 2010, what i found fascinating, republican gains, a lot of them came in wisconsin, michigan, pennsylvania. they all have republican governors. can mitt romney pull it out there, enough people to jump on top of him? >> first, mitt romney doesn't have a shot. might as well take it off the table. pennsylvania, you mention this idea of it being alabama in between. mitt romney won two or three counties in alabama. so i mean, this idea that they're passionate about mitt romney, that section of voters, is just not. there's a lot of resignation at this point. rick santorum could lose pennsylvania to mitt romney

because of timing. it is coming so late in the process, people got to the point they're just overwhelmed by mitt romney and they believe he is going to win anyway. >> i am from pennsylvania originally. i know that cargill quote well. he said it several years ago. pennsylvania has changed. we have seen changes in wilkes-barre and philadelphia area. i don't consider the middle of the state like kentucky or alabama like you said, i think it is like north carolina in a lot of ways. i think parts of the state have become more focused on business. i think out of the entire republican field from the start, i think that pennsylvanians, independents, preferred mitt romney over rick santorum. i think rudy giuliani when he was running four years ago made inroads there, he would have been the candidate a lot of people go for, four years ago obviously. >> i want to play a quick by the from santorum to something said

in 2008 about clinging to guns and religion. listen to what santorum said. >> barack obama four years ago referred to this area of pennsylvania, right here, as a place that holds on, clings to their guns and their bibles. you're damn right we do. >> congressman fattah, will that be a problem for president obama in 2012? >> it wasn't a few months after he said it in '08. he carried pennsylvania in the general election, and i think he'll be able to carry it again. most experts would say what you have, the 67 counties, most of the votes, you could win a landslide in pennsylvania by carrying 9 counties. most of the population is in philadelphia area, philadelphia suburbs. this fight over contraception, this attack on women's rights in general will not play well in

the philadelphia suburbs. democrats have to work hard because there will be attempts by republicans to mischaracterize the presidents record on a variety of things, and we have to make sure that we have the ability to put the facts forward about the level of investments made in pennsylvania by the federal government, the benefits in terms of turning around the economy, we have to make sure everyone that has the right to vote can freely exercise it on this election day. >> today on the front page of new york city, i found something interesting. you have a budget author, romney ally, turns into campaign focus, close alliance with paul ryan. you cover capitol hill, this is the ryan romney budget republicans are running on. is that a good alliance? >> i heard people describe the

romney, paul ryan relationship as a budget bromance in many ways. i think it is interesting. i don't think paul ryan's name is the albatross it was two years ago with that budget. i think democrats have a harder time running "the ed show" with paul line's name in it. americans are understanding what serious financial trouble the country is in, but i think it is still viable talking point for democrats when they talk about the country. >> a blow up here. >> i think paul ryan is political poison. in his district he is safe. i think nationally he represents a lot of what people recognize in republicans and fear about republicans in terms of budgetary policy. and i think any linkage between romney and ryan is dangerous for the middle, for the people that don't pay attention to every budget line, just see cut cut cut cut cut, harm harm harm, and

particularly attacks on things that generally help women, the poor, people like that. >> real quick, congressman. >> i voted for simpson bowls. >> you were in the great 38. >> the problem with the ryan budget, look what the growth says. ryan and romney are wrapping around this budget, doesn't get it around until 2040. adds trillions to debt. all they're doing is using fiscal challenges to cut programs they never supported at the beginning as republicans. whether medicare, education, legal services. they're not -- this is not a budget to get our fiscal house in order. it doesn't balance until 2040, doesn't do anything about the debt. we need a real solution to the problem. >> it is one of the -- i appreciate you all coming on. appreciate it.

a new op-ed in "the washington post" says there's a way to stop them. joining me now, fred worth heimer, president and ceo of democracy 21, an organization that promotes campaign reform and transparency in government. thank you for being on the program. >> good to be with you, luke. >> sir, you wrote yesterday in

"the washington post" while we cannot end all super pacs, as long as citizens united decision stands, we can eliminate the type of candidate specific super pacs being used in the presidential campaign. talk to me how you do this. can you bring me through it without the legalese? >> i will give it a shot. bottom line, the supreme court said super pacs can raise money from wealthy individuals, labor unions and others, and spend it to support a candidate, provided they are independent from the candidate. they left congress to define what independence means. now, the reality is all of the super pacs supporting presidential candidates, main ones, are arms of the campaigns, created by political associates of the candidates. their purpose is to evade,

circumvent limits on contributions to candidates. i can give $2500 if i had the money to a presidential candidate. i could give $5 million, $10 million as one individual has to a super pac supporting that candidate, as if it was going directly to the candidate. we can define what independence means, and the reality is the super pacs in the presidential campaign are not independent. that's absurd. >> we define what coordination means? >> that's correct. >> congress can write a law that says what type of coordination will be deemed illegal. right now, it is pretty broad. >> well, the big problem right now is we don't have enforcement of the law. it has been misinterpreted by the federal election commission, and they don't enforce the laws anyway. so while we think a lot of illegal activity already is

going on, it's allowed, and there's enough wiggle room here that people think they can get away with it. if you pass a statute to define in clear terms coordination, we can stop the groups in the future. and if we don't, they're going to spread to congress. they're vehicles for corruption. that's the bottom line here. they allow huge donors to give big amounts to buy influence with elected officials, and they're about the most dangerous thing in american politics today. >> and made of real money, let's talk about that. republicans super pac american crossroads raised $52 million in 2011, expects to raise $240 million this year and the conservative billionaire koch brothers expect to raise $200 million for other groups that oppose obama. obviously a lot of money will trickle to congress. if democrats could raise that amount of money they would, too, especially with the president's

super pac, but you said for this to improve, for coordination to be illegal, for it not to exist in current form, it would take an act of congress. of the hundreds of millions i mention, won't that trickle to congressional elections? wouldn't that put the onus on congress and they're benefitting from this? why would they ever change it? >> well, they'll change it when they get enough pressure to change it. we can't deal with all super pacs, as you mention. we can deal with the ones that support a particular candidate and raise money and spend it for that candidate. but "the washington post" poll recently showed that 70% of the american people think super pacs are illegal. by the end of this election, citizens are going to look at this system, think it is crazy, and that's because it is crazy. and i think we know that unlimited contributions lead to scandal and corruption. it happened in watergate, it is

jerry sandusky is in the courtroom for a pretrial hearing. he is accused of molesting 10 boys in a 15 year period. michelle franzen, seemed like a quick hearing. what happened and what's next? >> that hearing took all of 20 minutes. it was pretrial arguments for both sides, for sandusky's lawyers who a few weeks back filed that motion to dismiss all charges against sandusky. today, joe aftermath endole a, sandusky's attorney, filed not to dismiss that motion, saying in a future date he may also decide to file that motion once again. what that meant was the lawyers were telling the judge they didn't have enough information from prosecutors. they were arguing that they

needed more information about the alleged victims in this case as well as they were also arguing that some of the items searched during a search at sandusky's home should not be allowed to be used in that trial. the judge, however, will not be making any decisions on those arguments today. he has been meeting with lawyers behind closed doors since that hearing had just broken up, but sandusky himself did come here to this hearing today. he arrived at court here, he sat in the courtroom, listened to arguments on both sides, and a short time ago had left. of course, he is confined to his home throughout the pretrial and trial. as for the trial, the judge delayed it. it was supposed to start mid may. it is now delayed and set to start june 5th. >> thanks so much, michelle. we appreciate it. the los angeles coroner is out with the final report on the death of whitney houston. her body was found face down in the bathtub, had likely been

dead an hour. on the counter, they found a crystal like substance, in her drawer a white powdery substance. there were efforts to revive houston, including use of a defibrillator. five new orleans police officers were sentenced to prison terms ranging 6 to 65 years for roles in fatal shootings of unarmed residents and chaos following hurricane katrina, also convicted of civil rights violations and coverup. six unarmed civilians were shot, two killed in 2005. good news for the job market. the number of people filing for unemployment dropped to a four year low last week. labor department says 350,000 people applied for unemployment benefits. the number to watch though comes out tomorrow with march jobs report. tiger woods tees off today in his 15th masters tournament as a professional. he won four of them. looking for first win since 2009 and says his game is headed the

right direction. augusta national has been in the news for not allowing women to be members. however one of the biggest sponsors has a new female ceo who unlike predecessors hasn't been invited to join. what's more normal than america's past time? i will introduce you to these remarkable guys in about 20 minutes. who says there's no such thing as partnershipship in washington. president obama is inviting eric cantor, one of his chief rivals to attend a signing ceremony for new jobs legislation. kristin welker is live at the white house. i covered this bill on capitol hill a bit. you're going to see the signing at the white house. tell me a little about what's in this bill and if you think that this bipartisan koolaid these folks have been drinking will continue on through november. >> luke, hi there. if you ask lawmakers on both sides of the aisle publicly, they will say that they hope to

be able to come together and pass some more bills with broad, bipartisan support, but when you talk to them privately, which i know you do all the time, luke, they'll tell you it is election year. it will be tough to get movement on big pieces of legislation. what they will be facing, some appropriations bills and a transportation bill, but as far as these larger pieces of legislation, that's going to be really tough. as for today's signing ceremony, as you say, president obama invited house majority leader eric cantor, extending an olive branch. the two certainly clashed in the past. today a show of bipartisanship over the jobs bill, which basically gets rid of some of that regulatory red tape, helps small businesses get off the ground. yesterday president obama held another signing ceremony for the stock act which bans congressional insider trading. what's interesting about the signing ceremonies, the white

house hasn't held signing ceremonies in quite some time. republicans criticized the white house saying it is in an effort to paint congress as being obstructionist. so that criticism certainly will be blunted. we will watch closely to see what eric cantor has to say after that ceremony today. >> indeed, going to the sticks. yesterday had scott brown there, sean duffy of wisconsin, some blue state members wanting that photo op with president obama. kristin, thanks for being on the show. appreciate it. >> thanks, luke. we must unite behind one candidate so we can plummet toward victory in november. now, is mitt the best candidate? no. is he the true conservative candidate? nuh-uh, but he is the most candidate. therefo therefore, the next press of the

person. >> well, i think that's right, luke. first of all, i think stephen colbert should be in political business. he channels the hopes and dreams. this is the first time we had a long process. usually our primaries south carolina, maybe florida, instead of having three or four week primary, we had three or four month primary which allowed for more things to happen. as we've seen, a lot of things happened between then and now. >> alicia, are you surprised that romney is having trouble coalescing the base and getting excitement? ed gillespie goes to work for mitt romney, that tells me the establishment is behind him 110%, but it is not translating now into full blooded enthusiasm. people beating their chest with romney arms. is that going to come? >> i don't think so, and luke, you're asking exactly the right question, which is, you know, will this eventually happen. i think the problem is part of this has to do with romney, part

of it has to do with the republican party and their brand, but i think there's light at the end of the tunnel for republicans which is you have had ron paul who has been able to fire up younger conservatives, you have rick santorum who's also built big pockets of support. if those pockets of support can come to mitt romney, then you will see a more enthused gop than you're seeing now. the problem is those pockets are still staying in their corners. >> want to get both of your opinion on this, you read cross tabs of polling. a lot of democrats say this war on women helped distract from the issue of the economy. i'll start with you, alicia, then chip, please jump in. do you think the war on women narrative the democrats tried to perpetuate can hold up to the election? >> i think right now already you're seeing democrats take advantage of it. one of the problems with women particularly, unmarried women, we're transient, we move year to year. even if you're registered, you need to reregister. there are bigelow gistity cal

challenges. right now, democrats are taking the opportunity, sending mailers to segments of women, making sure they're engaged now. even if the narrative doesn't translate now to november, they will have built in a significant base of support. >> chip, can you get back on the economy or has this made a serious dent with women? >> i think it has made a short term dent obviously as you've seen polling and seen gender cap issues. as the economy and jobs become the central focus which it will in this campaign, that's the most important thing in the country, if you look at cross tabs and look deeper, that's the most important issue to men and women, it is not gender specific. the job is not a gender specific issue. >> it's the economy, stupid. thanks for being on the show. we appreciate it. >> thanks, luke. here is one way to deal with soaring fuel prices. buy your own oil refinery. aaa says gas prices are up another penny to $3.94 nationwide. up 18 cents from a month ago.

jet fuel prices also soaring, for g 5 owners. delta spent $12 billion on jet fuel is looking to buy a refinery in pennsylvania, according to cnbc. and jackie deangeles is here. this would be a first for a major airline going in the refinery business. >> that's right. cnbc reported dealt is considering a bid for an idle refinery. it has capacity of 185,000 barrels a day. the acquisition around $100 million. analysts we have spoken to are split on this. those in the positive camp say it is great for delta to take control of one of its highest costs, others say airlines are in enough trouble already. why enter another tough industry. also, it would be a major departure, excuse the pun, from delta's core operations. >> and jackie, speaking of first, finally it is here.
